For employers & HR teams

Know your exposure. Build the record.

Audit every shift, fix what is broken, and keep a dated record of the steps you took. Reformed PAGA materially limits penalties for employers who can show that record.

Not a big-company problem

Smaller employers carry real exposure

California PAGA and wage & hour settlements totaled about $1.3 billion in the first half of 2026, and 44% of settling employers had fewer than 200 employees. Read the mid-year analysis.

  • Know which locations and managers drive exposure
  • Fix scheduling and timekeeping patterns, not one shift at a time
  • Hand counsel a clean, verifiable dataset if a notice arrives
  • Show leadership a measured trend, not anecdotes

Who pays the settlement

Insurance often stops short of the settlement

Many employment practices liability (EPLI) policies exclude wage and hour claims. Where coverage exists, it is commonly limited to defense costs under a sublimit, with no coverage for the settlement itself. In that structure, the largest number in the matter is paid by the employer.

Policies vary. Ask your broker what yours covers before a notice arrives.

No policy? Build the hedge. A baseline audit tells you what you are carrying. Monthly runs show where to act and whether your fixes are holding. Audits you act on, together with lawful policies, supervisor training, and corrective action, are the reasonable steps that can cap PAGA penalties at 15 percent of the amount sought.

Questions from HR teams

What records do you need?

Time-punch and pay data for the period in scope, in any format: CSV, Excel, PDF, or screenshots from your timekeeping or payroll system. Nothing to install.

Can our outside counsel engage you?

Yes. Many engagements run through counsel. Where privilege matters, the work can run under your counsel's engagement, or we can coordinate a retainer arrangement.

Do you fix the problems you find?

No. We measure and document. Your HR team or counsel owns the fix, and monthly runs show whether it is working.
